TITLE
AN ORDINANCE TO REPEAL AND REPLACE CODE SECTION 521.06 - CONSTRUCTION, REPAIR, AND REPLACEMENT OF SIDEWALKS, INTEGRAL APPROACHES/APRONS AND RELATED AREAS; AND TO REPEAL AND REPLACE CHAPTER 903 - SIDEWALK CONSTRUCTION; AND DECLARING AN EMERGENCY
BODY
WHEREAS, the Department of Engineering has proposed a revised Sidewalk Program, consisting of new facilities, maintenance, and renewal activities, which is intended to integrate with the City’s capital improvement projects, such as major utility and transportation projects and street programs; and
WHEREAS, the revisions include accounting for adding new sidewalk facilities where they presently do not exist, providing a standard of care for distinguishing between maintenance and renewal, extending timelines for those desiring to opt out of the sidewalk maintenance program, and introducing an equitable cost share for affordability; and
WHEREAS, the revised Sidewalk Program necessitates major changes to Code Section 521.06 for Construction, Repair, and Replacement of Sidewalks, Integral Approaches/Aprons and Related Areas, as well as Code Chapter 903 for Sidewalk Construction; and
WHEREAS, the Administration recommends passage of this Ordinance as an emergency measure immediately necessary for the preservation of public peace, safety, health, and welfare of the City; to wit: the need to meet timelines outlined in the proposed Code changes and to align with required filing deadlines.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That Code Section 521.06 - Construction, Repair, and Replacement of Sidewalks, Integral Approaches/Aprons and Related Areas and Code Chapter 903 - Sidewalk Construction are hereby repealed.
Section 2. That new Code Section 521.06 - Duty to Keep Sidewalks and Vegetation Maintained (“EXHIBIT A” attached hereto and made a part herein) and new Code Chapter 903 - Sidewalk Construction, Maintenance, and Renewal (“EXHIBIT B” attached hereto and made a part herein) are hereby enacted.
Section 3. That for the reasons stated in the preamble above, this Ordinance is declared an emergency measure which shall be in full force and effect immediately upon passage by this Council and on the date of signature of approval by the Mayor.
