TO ACCEPT 41.997+/- ACRES FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA, OHIO, REQUESTED BY SHIRLEY A. WAGNER, TRUSTEE, ET AL.

WHEREAS, an application for annexation of 41.997+/- acres from Jefferson Township to the City of Gahanna, Ohio, has been duly filed and was denied by the Board of County Commissioners of Franklin County, Ohio, on February 4, 1998; and
WHEREAS, a Judgment Entry from the Court of Common Pleas was filed with the Clerk of Council of the City of Gahanna on January 22, 1999, decreeing that the denial of said petition for annexation " . . . IS HEREBY REVERSED. . ." by the court, and " . . . THE ANNEXATION IS HEREBY APPROVED . . . ;" and
WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law; and
WHEREAS, the City Attorney has directed that acceptance of said annexation must be placed before City Council;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the application of SHIRLEY A. WAGNER, TRUSTEE, ET AL., requesting the annexation to the City of Gahanna of 41.997+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, was Ordered by the Court of Common Pleas of Franklin County, Ohio, on January 21, 1999, to be approved for acceptance into the City, and said application, IS, THEREFORE, ACCEPTED.
Section 2. That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council AND ARE HEREBY ACCEPTED.
Section 3. That all services are to be constructed by the owner and/or developer.
Section 4. That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, Morse Road is designated as a principal roadway. Pursuant to Section 1109.02 of the Codified Ordinances of the City of Gahanna, a principal roadway right of way shall be 100 feet.
Section 5. That, in accordance with the provisions of Section 1133.08(b) of the Codified Ordinances, the owners, through their agent, have submitted a zoning application for this property.
Section 6. That this ordinance shall be in full force and effect at the earliest period allowed by law.
