WHEREAS, an application for annexation of 1.1+/- acres from Jefferson Township to the City of Gahanna, Ohio, has been duly filed and was granted by the Board of County Commissioners of Franklin County, Ohio, on April 8, 2003; and

 

WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the application of Roy J. Yoder requesting the annexation to the City of Gahanna of 1.1+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, on April 8, 2003, IS HEREBY ACCEPTED.

 

Section 2.  That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council.

 

Section 3.  That all services are to be constructed by the owner and/or developer.

 

Section 4.  That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, East Johnstown Road is designated as a minor arterial roadway.  Per the City of Gahanna, COG Section 1109.02, a minor arterial right-of-way shall be 80 feet.  According to the records, the present right of way on East Johnstown Road is 80 feet.  The city is requesting that the property already within present roadway right of way be deeded in fee to the City.  No additional right of way will be required.

 

Section 5.   That a zoning application has been filed with the Zoning Office for this newly-annexed parcel and said application will be forwaded to Planning Commission upon acceptance of this annexation.

 

Section 6.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
