Body

 

WHEREAS, application was made to the City by Triangle Properties to rezone 25.9, more or less,  acres on the south side of Taylor Road; and

 

WHEREAS, application was denied by Gahanna Planning Commission on February 24, 1999, and the resubmitted application was denied on May 12, 1999; and

 

WHEREAS, Appeal to City Council was filed in a timely manner on May 26, 1999; and

 

WHEREAS, this Council held public hearing on July 19, 1999, said hearing held pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Official Zoning Map, adopted by  Ordinance  No. 198.96, passed November 19, 1996, and as amended to date, is hereby amended by rezoning 25.9, more or less, acres on the South Side of Taylor Road, to AR, Apartment Residential; said acreage more particularly described in EXHIBIT A, attached to this ordinance and made a part herein.

 

Section 2.  That, prior to adoption of this rezoning, land dedication requirements for this rezoning must be recommended by Parks and Recreation Commission and affirmed by Planning Commission, with said affirmation and recommendation to  become attachment EXHIBIT B to this ordinance.

 

Section 3.  That the Clerk of Council is hereby authorized and directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.

 

Section 4.  That this ordinance shall be in full force and effect upon passage by this Council and 30 days after the date of signature approval of the Mayor.
