TITLE

A RESOLUTION TO DECLARE THE NECESSITY AND INTENT FOR ACQUISITIONS OF RIGHT-OF-WAY AND CONSTRUCTION EASEMENTS FOR THE WYNNE RIDGE BRIDGE PROJECT

BODY

 

WHEREAS, in 2021, the Wynne Ridge Court bridge was identified as a failing structure in the Ohio Bridge Inspection Summary Report, noting large spalls, heaving scaling, and wide cracks in the culvert; and

 

WHEREAS, in preparation for the ODOT-administered Wynne Ridge Bridge project slated for construction in 2025, the City needs to acquire right-of-way and temporary construction easements to facilitate the work; and

 

WHEREAS, the right-of-way and temporary construction easements are needed from four parcels to proceed with the construction project; and

 

WHEREAS, should the project’s authorized agents not be successful with negotiations with registered property owners, appropriations may need to be filed to obtain the right-of-way and construction easements.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1. That this Council hereby declares the necessity and intent to acquire right-of-way and temporary construction easements associated with parcels in the Wynne Ridge Bridge project pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, Charter of the City of Gahanna, Constitution of the State of Ohio, and Chapter 719 and Chapter 163 of the Ohio Revised Code; said parcels and owners more particularly described within EXHIBIT A, attached hereto and made a part herein.

 

Section 2. That the Mayor or Mayor’s representative is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner(s), person(s), in possession of and person(s) having a real or possible interest of record in the premises, and said notice shall be served by the Mayor or the Mayor’s representative, who shall make return of said service of notice in the manner provided by law.

 

Section 3. That this Resolution shall be in full force and effect immediately upon passage by this Council and upon signature of approval by the Mayor.
