TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH MIFFLIN TOWNSHIP BOARD OF TRUSTEES TO EXCHANGE LAND RESPECTIVELY WHEREBY THE CITY WILL RECEIVE CERTAIN INTEREST IN LAND AT 125 MILL STREET, FORMERLY A FIRE HOUSE LOCATION, AND THE TOWNSHIP WILL RECEIVE A PARCEL AT 4307 EAST JOHNSTOWN ROAD, CONSISTING OF 0.979 OF AN ACRE, MORE OR LESS; AND TO DECLARE AN EMERGENCY

WHEREAS, Mifflin Township Board of Trustees is desirous of locating a fire station in the northeast quadrant of the community; and
WHEREAS, the City is the owner of certain right of way at 4307 East Johnstown Road, which is not needed by the City for right of way purposes; and
WHEREAS, the City Administration has negotiated with the Trustees of Mifflin Township for an exchange of land, to the mutual satisfaction of both entities; and
WHEREAS, due to the expanding building in the northeast quadrant, it is both essential and desirous to increase safety forces in this newly-developed area, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Agreement with the Board of Trustees of Mifflin Township for an exchange of the properties known as 4307 East Johnstown Road right of way, consisting of 0.979 acre, for 125 Mill Street.
Section 2. That the City property known as the right of way at 4307 East Johnstown Road is more particularly described in EXHIBIT A, attached and made a part of this ordinance.
Section 3. That in authorizing this exchange, agreement has been made, upon subsequent development and sale of the property known as 125 Mill Street, the City will receive 25% of the net proceeds, and Mifflin Township will receive a 75% of the net proceeds.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
