WHEREAS, pursuant to Ohio Revised Code Sections 3735.65 et seq., this Council, on May 19, 1992, adopted its Substitute Resolution No. 29-92 that established the Community Reinvestment Area #3; and
 
WHEREAS, pursuant to Ohio Revised Code Sections 3735.65 et seq., this Council, on March 7, 1995, adopted its Resolution No. 17-95, which modified the boundaries of the Community Reinvestment Area #3; and
 
WHEREAS, pursuant to Ohio Revised Code Sections 3735.65 et seq., this Council, on December 31, 1998, adopted its Resolution No. 129-98, which modified the boundaries of the Community Reinvestment Area #3; and
 
WHEREAS, pursuant to Ohio Revised Code Sections 3735.65 et seq., this Council, on December 19, 2005, adopted its Statutory Resolution No. 3-2005 (collectively with Resolutions No. 29-92, No. 17-95, and No. 129-98, the "CRA Resolution"), which modified the boundaries of the Community Reinvestment Area #3; and
 
WHEREAS, this Council desires to further modify the boundaries of Community Reinvestment Area #3 and to modify the tax exemptions available within that area to encourage investment and construction within that area;
 
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  For the purposes of fulfilling the requirements set forth under Ohio Revised Code Sections 3735.65 to 3735.70, this Council adopts the findings of the Housing Survey for Community Reinvestment Area #3 currently on file with the Department of Planning & Development and reestablishes Community Reinvestment Area #3.  The findings of the Housing Survey are hereby incorporated into this Statutory Resolution as EXHIBIT B.
 
Section 2. The boundaries of Community Reinvestment Area #3 are hereby amended and restated in their entirety as EXHIBIT A attached hereto. This Council finds that the area included within Community Reinvestment Area #3 as shown on EXHIBIT A hereto is one in which housing facilities or structures of historical significance are located and new housing construction and repair of existing facilities or structures are discouraged.
 
Section 3.  Section 3 of the CRA Resolution is hereby amended and restated in its entirety to read as follows:
 
Section 3.  That within "Community Reinvestment Area #3" tax exemptions for improvements to real property as described in Section 3735.67 of the Ohio Revised Code will be granted for the following periods:
 
(a)       Ten (10) years for the remodeling of every dwelling containing not more than two family units upon which the cost of remodeling is at least two thousand five hundred dollars ($2,500) as described in Section 3735.67(D)(1) of the Ohio Revised Code.
 
(b)      Twelve (12) years for the remodeling or expansion of every dwelling containing more than two units, and commercial or industrial properties, upon which the cost of remodeling is at least five thousand ($5,000) as described in Section 3735.67(D)(2) of the Ohio Revised Code.
 
(c)      Fifteen (15) years for the construction of every dwelling, commercial or industrial structure as described in Section 3735.67(D)(4) of the Ohio Revised Code.
 
      To grant any tax exemption for commercial or industrial structures under the foregoing paragraphs (b) or (c), the City and the owner of the property to be exempted must enter into an agreement.  Nothing in this Section 3 shall be construed to require the City to enter into an abatement agreement and grant the tax exemption provided hereunder for commercial and industrial property.
 
Section 4.  Section 4 of the CRA Resolution is hereby amended to provide that the Director of Planning & Development is designated as the Housing Officer.
 
Section 5.  Except as amended hereby, the CRA Resolution shall remain in full force and effect.
 
Section 6.  That a copy of this Statutory Resolution will be forwarded to the Franklin County Auditor by the Director of Planning & Development for information and reference.
 
Section 7.  That the Director of Planning & Development is authorized to petition the Director of the Ohio Development Services Agency for the approval of Community Reinvestment Area #3 on behalf of this Council and pursuant to the requirements of Ohio Revised Code Section 3735.66.
 
Section 8.  This Council finds and determines that all formal actions of this Council and any of its committees concerning and relating to the passage of this Statutory Resolution were taken in an open meeting of this Council or its committees, and that all deliberations of this Council and any of its committees that resulted in those formal actions were in meetings open to the public, all in compliance with the law including Section 121.22 of the Ohio Revised Code.
 
Section 9.  That this Statutory Resolution shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
