WHEREAS, an application for annexation of 2.523+/- acres from Jefferson Township to the City of Gahanna, Ohio has been duly filed and was granted by the Board of County Commissioners of Franklin County, Ohio, on October 16, 2007; and

 

WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the application of Pierce Partners, LLC, requesting annexation to the City of Gahanna of 2.523+/- acres, more particularly described in EXHIBIT A, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, October 16, 2007, IS HEREBY ACCEPTED.

 

Section 2.  That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council.

 

Section 3. That all services are to be constructed by the owner and/or developer.

 

Section 4.  That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, Morse Road is designated as a major arterial roadway.  Pursuant to Section 1109.02 of the Codified Ordinances of the City of Gahanna, a principal arterial right of way shall be 100 feet.  Parcel 170-001112 requires a dedication of ten feet (10') of additional right of way and parcel 170-001006 requires a dedication of twenty feet (20') of additional right of way.  A deed for the additional right of way has been delivered to the City.

 

Section 5.  That a zoning application has been filed with the Zoning Office for this newly-annexed parcel and said application is being forwarded to the Planning Commission for review and recommendation.

 

Section 6.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
