TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION (ODOT) FOR SAFE ROUTES TO SCHOOL, PHASE II, IMPROVEMENT NO. ST 1002; AND TO DECLARE AN EMERGENCY.

WHEREAS, in April of 2013 the City of Gahanna enacted legislation proposing cooperation with ODOT on the construction of sidewalk on East Johnstown Road from Colony Place to Cherry Bottom Road, the upgrade signal at Johnstown/Cherry Bottom to include pedestrian crossing and pedestrian signals, the construction of sidewalk on Cherry Bottom Road from Johnstown Road to Springbrook Drive, sidewalk construction on Laura Drive from Heil Drive to existing walk, sidewalk segment construction on Heil Drive, and sidewalk construction from Heil Drive/Laura Drive to Jefferson Elementary school; and
WHEREAS, ODOT is scheduled to bid in 2015 with construction starting when school is on summer break; and
WHEREAS, it is imperative to move forward with this legislation in order to meet the ODOT schedule, and all for the preservation of the peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Agreement with the OHIO DEPARTMENT OF TRANSPORTATION, 1980 West Broad Street, Columbus, Ohio 43223; for the SRTS, Phase II project, Improvement No. ST 1002; Agreement attached as EXHIBIT A, and made a part herein.
Section 2. That funding was set aside in prior year funds to the following accounts to cover part of the herein costs:

Section 3. That funding was set aside in 2015 appropriations to Account No. 325.122.5596, Capital Improvement Fund, in the amount of ONE HUNDRED FIFTY NINE THOUSAND DOLLARS ($159,000) to cover the remainder of the herein costs.
Section 4. That, for the reasons set forth in the preamble hereinabove, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
