TO AUTHORIZE THE MAYOR TO ENTER INTO PRELIMINARY LEGISLATION AUTHORIZING A COOPERATIVE AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR SAFE ROUTES TO SCHOOL, PHASE II, IMPROVEMENT NO. ST 1002; AND TO DECLARE AN EMERGENCY.

WHEREAS, in May of 2012 the City was awarded an SRTS Phase II grant to design and construct a multi-use path on East Johnstown Road from Colony Place to Cherrybottom Road including upgrade of the signal to include pedestrian crossings with pedestrian signals and sidewalks will be included on Cherrybottom Road from Johnstown Road to Springbrook Drive and also on Laura Drive from Heil Drive connecting to the existing sidewalk; a sidewalk segment will be included on Heil Drive and also from the intersection of Heil Drive and Laura Drive to Jefferson Elementary School; and
WHEREAS, ORD-0046-2013 authorized detailed design and environmental work for the SRTS project, Phase II, and it must meet ODOT requirements; and
WHEREAS, to proceed with the project the City must pass preliminary legislation to enter into Cooperative Agreement with ODOT; and
WHEREAS, it is imperative to move forward with this legislation so that ODOT can authorize the Federal Funds for use in design, and all for the preservation of the peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Cooperative Agreement with the OHIO DEPARTMENT OF TRANSPORTATION, 400 East William Street, Delaware, OH 43015; for the SRTS, Phase II project, Improvement No. ST 1102; Cooperative Agreement/Preliminary Legislation attached as EXHIBIT A, and made a part herein.
Section 2. That the SRTS grant will reimburse the City for the entire design portion which must meet all of the ODOT requirements.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
