TITLE
A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT AMENDMENT WITH FISHBECK FOR ENGINEERING SERVICES DURING CONSTRUCTION FOR THE TAYLOR ROAD WATERMAIN REPLACEMENT PROJECT (ST-1121 / WA-24-01)
BODY
WHEREAS, the City of Gahanna entered into a professional services contract with Fishbeck for design, construction administration, construction inspection (CA/CI), and related services for the Taylor Road Watermain Replacement Project, identified as ST-1121 / WA-24-01; and
WHEREAS, by Resolution RES-0003-2026, adopted February 2, 2026, Council authorized the first amendment to the Fishbeck contract for additional construction administration, construction inspection, and related services associated with the project, which amendment required Council approval because the amended contract amount exceeded the applicable procurement threshold; and
WHEREAS, RES-0003-2026 increased the contract amount by Sixty-Nine Thousand Seven Hundred Twenty-One Dollars and Eighty Cents ($69,721.80), resulting in a total amended contract amount of Three Hundred Twelve Thousand One Hundred Twenty-One Dollars and Eighty Cents ($312,121.80); and
WHEREAS, the Taylor Road Watermain Replacement Project is currently under construction, and Fishbeck, as the City’s Engineer of Record for the project, is providing engineering services during construction on a time-and-materials basis; and
WHEREAS, Fishbeck has exhausted the estimated value of its currently authorized engineering services during construction, and continued construction administration and inspection services are necessary to verify that the project is constructed in accordance with the design intent and City material specifications and to protect public health and safety; and
WHEREAS, the Administration has determined that it is necessary and in the best interest of the City to further amend the existing contract with Fishbeck to provide for continued engineering services during construction; and
WHEREAS, the requested contract amendment is in the amount of Sixty-Four Thousand Thirty-Two Dollars and Nine Cents ($64,032.09), consisting of Forty-Six Thousand One Hundred Twenty Dollars ($46,120.00) for additional engineering services and Seventeen Thousand Nine Hundred Twelve Dollars and Nine Cents ($17,912.09) as contingency available for use by the City Engineer to address unforeseen additional costs; and
WHEREAS, the proposed contract amendment will increase the current contract amount of Three Hundred Twelve Thousand One Hundred Twenty-One Dollars and Eighty Cents ($312,121.80) to a total contract amount not to exceed Three Hundred Seventy-Six Thousand One Hundred Fifty-Three Dollars and Eighty-Nine Cents ($376,153.89); and
WHEREAS, sufficient funds have already been appropriated and are available within Account No. 65211000-5500 for this purpose, and no supplemental appropriation is required.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into a further contract amendment with Fishbeck, located at 1515 Arboretum Drive SE, Grand Rapids, Michigan 49546, in the amount of Sixty-Four Thousand Thirty-Two Dollars and Nine Cents ($64,032.09) for continued engineering services during construction associated with the Taylor Road Watermain Replacement Project (ST-1121 / WA-24-01), bringing the total amended contract amount to an amount not to exceed Three Hundred Seventy-Six Thousand One Hundred Fifty-Three Dollars and Eighty-Nine Cents ($376,153.89), and substantially in the form attached hereto as EXHIBIT A, subject to final approval by the City Attorney as to form.
Section 2. That of the amount authorized in Section 1, Seventeen Thousand Nine Hundred Twelve Dollars and Nine Cents ($17,912.09) shall be available as contingency for use by the City Engineer to address unforeseen additional costs associated with the engineering services during construction.
Section 3. That funding for this contract amendment has been previously appropriated and shall be paid from Account No. 65211000-5500.
Section 4. That this Resolution shall take effect and be in force from and after the earliest period allowed by law.
