TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH HOLT COMPANY OF OHIO FOR PURCHASE OF A BACKHOE WITH TAMPER AND HAMMER; TO SUPPLEMENTALLY APPROPRIATE $13,126; AND TO DECLARE AN EMERGENCY

WHEREAS, the Director of Public Service has researched backhoes, including demonstration by several manufacturers, and recommended that the City purchase a backhoe with tamper and hammer, from the State Contract bid list; and
WHEREAS, it is desirable to proceed with this contract at the earliest possible date, due to the pending construction season, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is authorized to award and the Mayor is authorized to enter into contract with HOLT COMPANY OF OHIO, 5252 Walnut Court, Columbus, Ohio 43228, in accordance with bid and City specifications.
Section 2. That funding in the amount of THIRTEEN THOUSAND ONE HUNDRED TWENTY SIX DOLLARS ($13,126) is hereby supplementally appropriated from the unappropriated, unencumbered Balance of the Water Fund to Account No. 651.350.5512, Water Capital Projects/Equipment, and from the Sewer Fund to Account No. 661.360.5512, Sewer, Capital Equipment, equally, to cover the herein costs.
Section 3. That funding in the amount of FORTY THREE THOUSAND DOLLARS ($43,000) was appropriated in the 2000 appropriations to Account Nos. 651.350.5512, Water Capital Projects/Equipment, and 661.360.5512, Sewer Capital Equipment, equally, to further cover the herein costs.
Section 4. That ORD-1-2000, passed January 3, 2000 is hereby amended.
Section 5. That for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
