Title

TO AUTHORIZE THE CITY ATTORNEY TO PETITION THE BOARD OF COUNTY COMMISSIONERS OF FRANKLIN COUNTY, OHIO, TO ANNEX CERTAIN 0.54+/- ACRES FROM MIFFLIN AND JEFFERSON TOWNSHIPS, SAID LAND LOCATED OFF HAMILTON ROAD; AND TO DECLARE AN EMERGENCY.

Body

WHEREAS, it is the desire of the City of Gahanna to annex a certain portion of roadway right of way recently deeded to the City; and

 

WHEREAS, authorization in Ordinance No. 980406, passed October 19, 1998, was faulted due to description of the parcel involved, and revision was necessary due to right of way ownership and width issues; and

 

WHEREAS, the proposed annexation is limited to the lands adjoining the proposed Beecher Road/Hamilton Road dedication; and

 

WHEREAS, a new legal description has been developed and it is necessary to proceed at the earliest possible date to annex this parcel for orderly development of this growth area of the City; and

 

WHEREAS, Section 709.14 of the Ohio Revised Code requires that a representative to appointed by the City to prosecute said annexation proceedings; and

 

WHEREAS, an emergency exists in the usual daily operation of the City to immediately annex the herein described land, thereby preserving the public health, peace, property, safety, and welfare of the residents;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That it is necessary and in the best interest of the City of Gahanna to annex 0.54+/- acres of roadway right of way, said acreage more particularly described in EXHIBIT A, attached to this ordinance and made a part herein.

 

Section 2.  That the City Attorney is authorized and directed to effect all documentation necessary to completion of this annexation before the Board of   Commissioners of Franklin County.

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
