A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN ELECTRIC SUPPLY AGREEMENT FOR CITY FACILITIES FOLLOWING TRADITION ENERGY’S PRICING ANALYSIS AND RECOMMENDATION (OMNIA PARTNERS PROCUREMENT) AND AUTHORIZING RELATED ACTIONS TO EFFECTUATE AGREEMENT

WHEREAS, the City of Gahanna maintains approximately sixty-seven (67) electric utility accounts that serve municipal buildings, park facilities, street lighting and other city operations; and

 

WHEREAS, in order to leverage favorable market pricing and competitive contract terms for electric supply, the City engaged Tradition Energy, an independent energy advisor, to assist with data collection, usage analysis, market evaluation and contract review; and

 

WHEREAS, Tradition Energy’s services are being provided through the cooperative purchasing framework of the Omnia Partners Consortium, allowing the City to access competitive offerings without separate solicitation; and

 

WHEREAS, electric supply market pricing is often available for only a very short window once offered, and securing the most advantageous pricing for the City may require immediate execution of an agreement following Tradition Energy’s pricing analysis and recommendation; and

 

WHEREAS, the Administration has recommended that the Mayor be authorized to enter into an electric supply agreement in accordance with Tradition Energy’s recommendation and the Omnia Partners procurement program so the City may secure the best available pricing and contract terms for its electric accounts.

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN COUNTY, STATE OF OHIO:

 

Section 1. The Mayor is hereby authorized to enter into an electric supply agreement for the City’s electric utility accounts, in a form approved by the City Attorney, upon completion of Tradition Energy’s pricing analysis and upon Tradition Energy’s written recommendation of the supplier and contract terms, provided that such terms are determined by Tradition Energy and the Mayor to be in the best financial interest of the City. The Mayor is further authorized to execute any and all ancillary documents reasonably necessary to effectuate such agreement, including amendments, renewals, notices and certificates, consistent with the recommendation.

 

Section 2. Council confirms that such agreement may be procured through the Omnia Partners cooperative purchasing program and authorizes use of that program as the appropriate procurement vehicle for the electric supply agreement.

 

Section 3. As soon as practicable, but no later than ten (10) business days after execution of any electric supply agreement authorized by this Resolution, the Administration shall provide Council with a copy of the executed agreement, a summary of key terms (including supplier name(s), contract term, pricing, expected annual cost and estimated savings or budget impact), and the rationale for the selection in accordance with Tradition Energy’s recommendation.

 

Section 4. This Resolution authorizes the Mayor to enter into an agreement and to take steps necessary to implement them; it does not, by itself, appropriate new funds beyond those otherwise available. Any supplemental appropriation or formal budget amendment required to fund the agreement(s) shall be presented to Council for approval in accordance with the City’s financial procedures.

Section 5. That this Resolution shall be in full force and effect after passage by this Council and on date of signature of approval by the Mayor.
