TO ACCEPT THE ANNEXATION OF 5.4+/- ACRES FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA, OHIO, LOCATED AT 4436 EAST JOHNSTOWN ROAD; REQUESTED BY DOUGLAS E. SAGER, ET AL

WHEREAS, an application for annexation of 5.4.7+/- acres from Jefferson Township to the City of Gahanna, Ohio, has been duly filed and was granted by the Board of County Commissioners of Franklin County, Ohio, on August 1, 2001; and

 

WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the application of Douglas E. Sager, et al, requesting the annexation to the City of Gahanna of 5.4+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, on August 1, 2001, IS HEREBY ACCEPTED.

          

Section 2.  That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council.

 

Section 3.  That all services are to be constructed by the owner and/or developer.

 

Section 4.  That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, U.S. Route 62 is a minor arterial.  A minor arterial requires an 80 foot right of way.  To comply with the provisions of Section 121.05 of the Codified Ordinances of the City of Gahanna, the right of way required from the subject property would be 40 feet from the centerline of East Johnstown Road.

 

Section 5.  The City Attorney under the provisions of Section 121.05(b) of the Codified Ordinances has waived said right of way requirement as a condition of accepting this annexation.  The required right of way shall be deeded to the City upon development or rezoning.

 

Section 6.  That Gahanna Planning Commission is requested to make an initial zoning recommendation to Council for this newly-annexed parcel.

 

Section 7.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
