TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH NICKOLAS SAVKO & SONS FOR REPLACEMENT OF WATERLINE ALONG HAMILTON ROAD ADJACENT TO THE SHOPS AT ROCKY FORK; IMPROVEMENT NO. ST 1023; TO WAIVE THE FORMAL BIDDING PROCESS DUE TO SPECIAL CIRCUMSTANCES; TO SUPPLEMENTALLY APPROPRIATE $115,470; AND TO DECLARE AN EMERGENCY.

WHEREAS, the Shops at Rocky Fork is a new commercial development to be built along South Hamilton Road; and
WHEREAS, this development will install new landscaping and sidewalk in the lawn strip along Hamilton Road; and
WHEREAS, the existing waterline in the lawn strip is asbestos cement which the City has been replacing due to its fragile nature, and once the landscaping is installed it will be more difficult to access the line to make repairs; and
WHEREAS, the City asked the contractor of the project to price replacing the waterline as a part of the development project and it would be an efficient solution; and
WHEREAS, it is imperative to move forward with the installation of this waterline so that the work can begin as soon as possible during the building season, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with Nickolas Savko & Sons, 4636 Shuster Road, Columbus Ohio 43214, for construction of the replacement waterline along Hamilton Road adjacent to the Shops at Rocky Fork project; Improvement No. ST 1023; quote attached as EXHIBIT A, and made a part herein.
Section 2. That the formal bidding process is hereby waived as the contractor will already be on site doing work on the project.
Section 3. That funding in the amount of ONE HUNDRED FIFTEEN THOUSAND FOUR HUNDRED SEVENTY DOLLARS ($115,470) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Water System Capital Fund to Account No. 652.351.5596, Water System Capital Projects/Improvements, to cover the herein cost.
Section 4. That ORD-0001-2014, passed January 2, 2014 is hereby amended to reflect this supplemental appropriation.
Section 5. That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature of approval by the Mayor.
