TITLE
AN ORDINANCE TO AMEND THE TRAFFIC CODE OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; TO PROVIDE FOR PENALTIES; TO PROVIDE FOR CODIFICATION; TO PROVIDE FOR SEVERABILITY; TO REPEAL CONFLICTING ORDINANCES; AND TO ESTABLISH AN EFFECTIVE DATE

WHEREAS, pursuant to Ohio Revised Code Section 715.03, the City of Gahanna is authorized to adopt ordinances relating to its property, affairs, and local government; and
WHEREAS, it is necessary to amend certain provisions of the Traffic Code of the Codified Ordinances of the City of Gahanna to reflect updates and revisions to applicable traffic regulations; and
WHEREAS, the proposed amendments affect Gahanna City Code Sections 301.02, 301.031, 301.04, 301.041, 301.042, 301.043, 301.044, 301.045, 301.09, 301.13, 301.162, 301.163, 301.17, 301.171, 301.182, 301.22, 301.26, 301.28, 301.29, 301.30, 301.33, 301.35, 301.37, 301.42, 301.45, 301.46, 301.47, 301.481, 301.491, 301.51, 313.02, 313.03, 313.04, 313.09, 313.10, 313.12, 331.33, 331.35, 331.38, 331.39, 331.40, 333.032, 333.11, 335.03, 335.072, 335.074, 335.09, 337.24, 337.28, 341.01, 351.03, 371.01, 371.03, 371.06, 371.11, and 371.12; and
WHEREAS, the proposed amendments are set forth in EXHIBIT A, attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Traffic Code of the Codified Ordinances of the City of Gahanna is hereby amended as set forth in this Ordinance and the attached EXHIBIT A.
Section 2. That the additions, amendments, and deletions to the Gahanna City Code adopted by this Ordinance shall be incorporated into the Codified Ordinances of the City of Gahanna, and references to the Codified Ordinances shall include such additions, amendments, and deletions.
Section 3. That the codifier, meaning the person, agency, or organization authorized to prepare supplements to the Codified Ordinances of the City of Gahanna, is hereby authorized to exclude or omit any provisions of this Ordinance that are inapplicable to the codified text.
Section 4. Supplementation of Code.
(a) In preparing a supplement to the Codified Ordinances, all provisions repealed by this Ordinance shall be excluded from the Codified Ordinances by omission from the reprinted pages.
(b) In preparing a supplement to the Codified Ordinances, the codifier may make formal, nonsubstantive changes to this Ordinance and its provisions, insofar as necessary to incorporate them into a unified code. Such changes may include:
1. Organizing ordinance material into appropriate subdivisions;
2. Providing appropriate catchlines, headings, and titles for sections and other subdivisions of the Codified Ordinances and making corresponding changes to such catchlines, headings, and titles;
3. Assigning appropriate numbers to sections and other subdivisions to be inserted into the Codified Ordinances and, where necessary to accommodate new material, changing existing section or subdivision numbers;
4. Changing the words "this Ordinance" or words of similar meaning to "this chapter," "this article," "this division," or other appropriate references, or inserting applicable section numbers to identify the provisions incorporated into the Codified Ordinances; and
5. Making other nonsubstantive changes necessary to preserve the original meaning of the provisions incorporated into the Codified Ordinances.
In no event shall the codifier make any change affecting the substantive meaning or legal effect of the provisions adopted by this Ordinance or already incorporated into the Codified Ordinances.
(c) The pages of any supplement shall be numbered and prepared to fit properly into the Codified Ordinances and, where necessary, replace obsolete or partially obsolete pages so that the Codified Ordinances remain current through the date of adoption of the latest ordinance included in the supplement.
Section 5. That any provisions adopted pursuant to Section 6 of this Ordinance that duplicate or correspond to state statutes having an effective date later than the effective date of this Ordinance shall not become effective until the corresponding state statutes take effect.
Section 6. Adoption of Traffic Code Amendments. That the additions, amendments, and deletions to the Traffic Code of the Codified Ordinances of the City of Gahanna, as specifically set forth in EXHIBIT A, attached hereto and incorporated herein by reference, are hereby approved, adopted, and enacted. The provisions of EXHIBIT A shall be incorporated into the Codified Ordinances of the City of Gahanna in accordance with this Ordinance.
Section 7. Severability. That if any section, subsection, sentence, clause, phrase, or portion of this Ordinance, or its application to any person or circumstance, is held invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance or their application to other persons or circumstances. City Council hereby declares that it would have adopted this Ordinance and each provision thereof irrespective of the invalidity of any other provision and, to that end, the provisions of this Ordinance are hereby declared severable.
Section 8. Repeal of Conflicting Ordinances. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 9. Effective Date. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
