TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH 2K GENERAL COMPANY, FOR PHASE II GENERAL CONTRACTING, PLUMBING AND HVAC CONSTRUCTION OF HANNAH FARMS PARK; AND TO DECLARE AN EMERGENCY.

WHEREAS, design is complete and construction can begin on Phase II of Hannah Farms Park; and
WHEREAS, bids were opened on October 6, 2008 and the lowest, most responsive and responsible bidder has been recommended by the Director of Public Service and the Director of Parks & Recreation; and
WHEREAS, the lowest bidder on the plumbing portion of the contract stated that the plumbing bid was not for a stand alone contract but reflected pricing as part of the larger bid; and
WHEREAS, it is imperative to move forward so that work on Phase II of the park can commence at once, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is hereby authorized to award and the Mayor is authorized to enter into contract with 2K GENERAL COMPANY, 6019 Columbus Pike, Lewis Center, OH 43035, for Phase II general contracting, plumbing and HVAC construction for the Hannah Farms Park project; in accordance with City specifications; bid tabs attached as EXHIBIT A.
Section 2. That funding in the amount of TWO HUNDRED SEVENTY THOUSAND DOLLARS ($270,000) is hereby supplementally appropriated from the unappropriated unencumbered balance of the Capital Improvement Fund to Account No. 325.122.5596, Capital Projects, to cover a portion of the herein costs.
Section 3. That funding in the amount of FIVE HUNDRED TWENTY SIX THOUSAND FIVE HUNDRED DOLLARS ($526,500) has been set aside from Bond Proceeds approved by ORD-0095-2007, to Account No. 101.431.5596, Parks Capital Projects/Improvements, to cover the balance of the herein costs.
Section 4. That ORD-001-2008, passed January 2, 2008, is hereby amended to reflect this supplemental appropriation.
Section 5. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
