AND SUE WILLIAMS, IN THE AREA EAST OF HAMILTON ROAD AND SOUTH OF MORSE ROAD; FOR SANITARY SEWER EASEMENT FOR THE TRIANGLE WEST SANITARY SEWER, IMPROVEMENT NO. 740.

WHEREAS, in 2000 the City acquired easements to build the Triangle West sanitary sewer but was unable to reach a settlement agreement with Jack and Sue Williams for 0.141 acres of land; and

 

WHEREAS, because there were time limitations to provide service a pump station was built to avoid the easement issue; and

 

WHEREAS, the City Engineer recently analyzed the maintenance cost of the pump station and has concluded in two years it will be more cost effective to build the gravity sewer originally planned and remove the pump station; and

 

WHEREAS, it is now necessary to obtain the sanitary sewer easement of 0.141 acres through property owned by Jack and Sue Williams in the area east of Hamilton Road and South of Morse Road; 

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That this Council hereby declares the necessity and intent to appropriate a certain parcel of real estate for purchase consisting of 0.141 acres for sanitary sewer easement; by the City of Gahanna for the Triangle West Sanitary Sewer, Improvement No. 740; property owned by Jack A. and Sue Williams in the area east of Hamilton Road and South of Morse Road; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code; said parcel more particularly described in EXHIBIT A, attached hereto and made a part herein.

 

Section 2.  That the City Attorney or his representative is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest or record in the premises described in EXHIBIT A, herein, and said notice shall be served by said City Attorney or his representative, who shall make return of said service of notice in the manner provided by law.

 

Section 3.  That this statutory resolution shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
