TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH MILLER PAVING FOR THE 1998 ASPHALT OVERLAY PROGRAM, IMPROVEMENT NO. 645, FOR $422,900; TO PROVIDE ADDITIONAL FUNDING THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, bids were received on April 10, 1998, and the lowest, responsive and responsible bidder has been recommended to this Council by the Director of Public Service and the City Engineer; and
WHEREAS, it is imperative, due to the number of street miles to be covered by this program, to move rapidly to approve this authorizing contract in order to complete street overlay before the winter season for orderly movement of traffic and for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is hereby authorized to award and the Mayor is authorized to enter into contract with MILLER PAVING, 4540 Edgewyn Avenue, Hilliard Ohio 43026 for a total amount of Four Hundred and Two Thousand Seven Hundred Fifty-three Dollars plus 5% contingency, for a grand total of Four Hundred Twenty-two Thousand Nine Hundred Dollars ($422,900) for the 1998 Asphalt Overlay Program, Improvement No. 645, in accordance with City and bid specifications.
Section 2. That funding was set aside in the 1998 Appropriations to cover the herein costs as follows: $12,983 for the Golf Course Parking Lot from Account No. 101.433.5512, Capital Projects, Golf Course; $6,686 for Shull Park Parking Lot from Account No. 101.431.5515, Capital Projects, Parks and Recreation; $200,000 from Account No. 220.330.5547, Paving; and $184,911 from Account 101.145.5541, Capital Projects, Streets.
Section 3. That the amount of EIGHTEEN THOUSAND THREE HUNDRED TWENTY DOLLARS ($18,320) is hereby supplementally appropriated from the General Fund to Account No. 101.343.5511, Capital Projects, Development, for parking lots at the Chamber Building and the Olde Gahanna Sanctuary.
Section 4. That Ordinance No. 980001, passed January 2, 1998, is hereby amended to reflect this supplemental appropriation.
Section 5. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
