TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH OHIO DEPARTMENT OF TRANSPORTATION TO PROCEED WITH THE I-270 RAMP MODIFICATION PROJECT, FRA-IR270-37.04, PID NUMBER 80721; IMPROVEMENT NO. 797; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0003-2006 authorized the Mayor to enter into LPA Federal Project Agreement with ODOT for Hamilton Road ramp modifications at the IR270/SR317 interchange; and
WHEREAS, this project is being funded in part by the American Recovery and Reinvestment Act (ARRA) and funds from that Act are capped at the Federal share amount; and
WHEREAS, everything is in order to proceed with the project and ODOT requires legislation to begin said project; and
WHEREAS, it is imperative to move forward with this ordinance so that it can be passed by the March 12, 2010 ODOT deadline, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Contract with the Ohio Department of Transportation to proceed with the I-270 Ramp Modification Project, PID 80721, Improvement No. 797; said Contract attached as EXHIBIT A, and made a part herein.
Section 2. That the proposed project consists of widening of I-270 ramps at Hamilton Road and median improvements on Hamilton Road. The intent of this project is to improve the traffic congestion and improve safety of the eastbound and westbound exit ramps on to Hamilton Road. The project includes, but is not limited to, consolidating the two interchange ramps and Hamilton/Morrison signalization, eliminating the free flow I-270 exit ramps to northbound and southbound Hamilton Road, widening of Ramps E & L to accommodate a right turn lane, installing ramp metering on Ramps A & T at Hamilton Road and installing a median planter on Hamilton Road south of Morrison Road. The existing roadway on both Ramps E & L will be widened from two lanes to three lanes to accommodate a right turn lane to north and southbound Hamilton Road. Hamilton Road will be widened to the east to provide a northbound right lane to eastbound Morrison Road and shoulders will be upgraded to current standards, lying within the City of Gahanna.
Section 3. That the LPA shall cooperate with the Ohio Director of Transportation in the above described project as follows:
The City agrees to assume and bear one hundred percent (100%) of the entire cost of the improvement, less the amount of Federal-aid MORPC and MORPC ARRA funds set aside by the Ohio Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation.
In view of the fact that the LPA's share of the project is now estimated in the amount of Three Hundred Forty Six Thousand Seven Hundred Seventy One Dollars ($346,771) less Ohio Public Works Commission Grant (CCT04) in the amount of Three Hundred Forty Six Thousand Seven Hundred Seventy One Dollars ($346,771) leaving the balance due of zero, therefore, the City will not be required to deposit any funds at this time. The LPA's ultimate share of the cost will be determined when final actual costs and allocations are determined.
Section 4. That the LPA recognizes that it is responsible for all change orders and that the Department recommends the LPA set aside at least 6% of the total project cost to pay for potential change orders and cost overruns.
Section 5. That the Ohio Director of Transportation has approved said legislation proposing cooperation and has caused to be made plans and specification and an estimate of cost and expense for improving the above described highway and has transmitted copies of same to the legislative authority.
Section 6. That the estimated sum of $1,909,645 was appropriated from Federal-aid MORPC and MORPC ARRA funds set aside by the Ohio Director of Transportation, for the improvement described above and the fiscal officer was authorized and directed to issue an order on the treasurer for said sum upon the requisition of the Ohio Director of Transportation to pay the cost and expense of said improvement. The LPA hereby agrees to assume in the first instance, the share of the cost and expense over and above the amount to be paid from Federal funds.
Section 7. That the LPA hereby requests the Ohio Director of Transportation to proceed with the aforesaid highway improvement.
Section 8. That the LPA transmit to the Ohio Director of Transportation a fully executed copy of this Ordinance.
Section 9. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
