WHEREAS, application has been made for Canini & Pellecchia, Inc. by Glen A. Dugger to zone 3.59+/- acres recently annexed as L-SO, Limited Overlay Suburban Office, said property located on Shagbark Road; and

 

WHEREAS, application has been made for Canini & Pellecchia, Inc. by Glen A. Dugger to rezone 8.75+/- acres as L-CC, Limited Overlay Community Commercial; to rezone 2.484+/- acres as L-SO, Limited Overlay Suburban Office; and to rezone 6.3+/- acreas as L-AR, Limited Overlay Apartment Residential, said property located on Beecher Road and Johnstown Road; and 

 

WHEREAS,  Planning Commission held Public Hearing on April 12, 2000 and recommended these requests for initial zoning and for rezoning on May 10, 2000; and

 

WHEREAS, City Council held Public Hearing on July 5, 2000, in regular meeting, said meeting held pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Official Zoning Map, adopted by Ordinance No. 198-96, passed November 19, 1996, and as amended to date, is hereby amended by zoning 3.59+/- acres as L-SO, Limited Overlay Suburban Office, said acreage more particuarly described in EXHIBIT A, attached to this ordinance and made a part herein.

 

Section 2.  That the Official Zoning Map, adopted by Ordinance No. 198-96, passed November 19, 1996, and as amended to date, is hereby amended by rezoning 8.75+/- acres as L-CC, Limited Overlay Community Commercial, said acreage more particuarly described in EXHIBIT B, attached to this ordinance and made a part herein.

 

Section 3.  That the Official Zoning Map, adopted by Ordinance No. 198-96, passed November 19, 1996, and as amended to date, is hereby amended by zoning 2.484+/- acres as L-SO, Limited Overlay Suburban Office, said acreage more particuarly described in EXHIBIT C, attached to this ordinance and made a part herein.

 

Section 4.  That the Official Zoning Map, adopted by Ordinance No. 198-96, passed November 19, 1996, and as amended to date, is hereby amended by zoning 6.3+/- acres as L-AR, Limited Overlay Apartment Residential, said acreage more particuarly described in EXHIBIT D, attached to this ordinance and made a part herein.

 

Section 5.  That the text and site plan as required by Section 1152.02(d), Development Plan, of Section 1152.02, Limited Overlay District, is attached to this ordinance as EXHIBIT E, and is made a part herein.

 

Section 6.  That the public areas dedication required under Section 1109.08 for the L-AR portion of this rezoning shall be in the form of fees in lieu of park land and shall follow the procedure outlined in Section 1109.08(h) (i) and (j) of the Codified Ordinances.

 

Section 7.  That the Clerk of Council is hereby authorized and directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.

 

Section 8.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature approval by the Mayor.
