WHEREAS, development of office, commercial and condominiums along Beecher Crossing North cannot be started until the roadway is completed and accepted to public use; and

 

WHEREAS, final development plans will be submitted for each of the developments along this roadway; and

 

WHEREAS, it is imperative to move forward with this road dedication plat at the earliest possible date, all for the orderly flow of vehicular traffic and for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the final plat entitled "Beecher Crossing North Dedication and Easements," more particularly described as follows:

 

Situated in the State of Ohio,  County of Franklin, City of Gahanna, located in Quarter Township 2, Township 1, Range 16, United States Military Lands, containing 1.033 acres of land, more or less, said 1.033 acres being comprised of a part of each of those tracts of land conveyed to Canini & Pellecchia, Inc., by deeds of record in Official Record 34320J14, Instrument Number 199801120007649, Instrument Number 199801200012301 and Instrument Number 199908110204889, Instrument Number 199802100012302 and Instrument Number 199808110204889, Recorders Office, Franklin County, Ohio

 

be, and the same is hereby approved and accepted, and the dedication to public use of all or parts of Beecher Crossing North not heretofore dedicated to public use, be and the same are hereby accepted and confirmed, subject to all requirements as set out in Chapter 1107, 1109, 1193 and 1195 of the Codified Ordinances of Gahanna, Ohio.

 

Section 2.  That Beecher Crossing North Dedication and Easements Plat, consisting of 1.003 acres, meets all requirements of the various zonings approved by the City in prior actions.

 

Section 3.  That the City Engineer has certified that Beecher Crossing North Dedication and Easements Plat will meet all requirements of storm water and design requirements for adequate on-site drainage and the ability to accept runoff from land tributary to the development.

 

Section 4.  That easements so indicated on the Beecher Crossing North Dedication and Easements Plat are hereby reserved in, over and under areas designated on this plat as easement, for the construction, operation, and maintenance of all public and quasi public utilities above and beneath the surface of the ground and, where necessary, for the construction, operation, and maintenance of service connections to all adjacent lots and lands and for storm water drainage.

 

Section 5.  That said Final Plat for Beecher Crossing North Dedication and Easements is attached to this ordinance as EXHIBIT A and made a part herein.

 

Section 6.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
