WHEREAS, an application for annexation of property located at 5061 Shagbark and 1150 North Hamilton Road consisting of 3.4+/- acres from Jefferson Township to the City of Gahanna, Ohio, has been duly filed and was granted by the Board of County Commissioners on November 1, 2011; and
 
WHEREAS, the 0.826+/- acre parcel located at 1150 N. Hamilton Road is owned by Robert L. Roshon, et al; and
 
WHEREAS, the 2.45+/- acre parcel located at 5061 Shagbark Road is owned by Jack A. and Sue Williams; and
 
WHEREAS, the City Attorney has directed the Clerk of Council to place this acceptance before Council at the earliest possible date in order to expedite appropriate maintenance of the property;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the application of the City of Gahanna, requesting the annexation to the City of Gahanna of 3.4+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, on November 1, 2011, IS HEREBY ACCEPTED.
          
Section 2.  That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council.
 
Section 3.  That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, Hamilton Road requires 120 feet of right of way and the current right of way is 120 feet; therefore no additional right of way is required.
 
Section 4.  That in conformance with Section 1133.08 of the Codified Ordinances zoning applications have been filed with the Zoning Office for these newly-annexed parcels and said application will be forwarded to Planning Commission for review and recommendation.
 
Section 5.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
