TO AUTHORIZE THE MAYOR TO ENTER INTO DEVELOPER'S AGREEMENT WITH THE PIZZUTI COMPANY FOR THE CONSTRUCTION OF A ROAD EXTENDING EAST FROM EASTGATE TO NEW-ALBANY REYNOLDSBURG ROAD (NORTH STREET); TO ACCEPT AND FACILITATE $200,000 FROM THE OHIO DEPARTMENT OF DEVELOPMENT 629 GRANT; AND TO DECLARE AN EMERGENCY

WHEREAS, Pizzuti Company has determined to construct a Roadway Improvement, pay or cause to have paid, any costs of the design and construction of the Roadway Improvement not otherwise paid from the 629 Grant and, upon completion, provide for any required dedication of such Roadway Improvement to the appropriate political jurisdiction; and
WHEREAS, the City, is desirous of promoting the economic welfare and improving the economic opportunities of the people in the City, respectively by assisting in the establishment or expansion within the City of industrial, commercial, or research facilities and by creating and preserving job and employment opportunities for the people of the City; and
WHEREAS, it is imperative to move forward with this immediately so that construction can begin this year, all for the preservation of the public peace, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA:
Section 1. That the Mayor is hereby authorized to enter into Developer's Agreement with Pizzuti Company for the construction of the road extending east from Eastgate to New Albany-Reynoldsburg Road (North Street), said Agreement attached hereto as EXHIBIT A and made a part of this ordinance.
Section 2. That the amount of TWO HUNDRED THOUSAND DOLLARS ($200,000) will be accepted and facilitated from the Ohio Department of Development 629 Grant at which time a supplemental appropriation will be done.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
