TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR GAHANNA INFRASTRUCTURE SRTS, PID NUMBER 88483; ALSO KNOWN AS THE SAFE ROUTES TO SCHOOL PHASE I, IMPROVEMENT NO. ST 961 PROJECT; TO AUTHORIZE PAYMENT TO ODOT FOR THE CITY'S PORTION OF THE PROJECT; TO SUPPLEMENTALLY APPROPRIATE $28,638; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0116-2010 authorized Cooperative Agreement with ODOT for the Safe Routes to School (SRTS) Phase I Project which adds infrastructure to assist students walking to school; and
WHEREAS, the City of Gahanna shall cooperate with the Director of Transportation in the above described project as follows: The City agrees to assume and bear one hundred percent (100%) of the entire cost of the improvement, less the amount of Federal-aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation and further, the City agrees to assume and bear one hundred percent (100%) of the cost of Preliminary Engineering and Right-of-way, excluding in-house preliminary engineering and Right-of-way charges incurred by the State. The share of the cost of the City is now estimated in the amount of four hundred sixty seven thousand eight hundred seventy one dollars ($467,871), but said estimated amount is to be adjusted in order that the LPA's ultimate share of said improvement shall correspond with said percentages of actual costs when said actual costs are determined; and
WHEREAS, SRTS Phase I Improvement ST 961 consists of city-wide pedestrian safety improvements, including 0.65 miles of non-motorized facility, curb and gutter, storm sewer, water line, driveway aprons, traffic signals, pavement markings and bicycle racks, lying with the City of Gahanna; and
WHEREAS, the Director of Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described SRTS project and has transmitted copies of the same to this legislative authority; and
WHEREAS, the City of Gahanna desires that the Ohio Department of Transportation proceed with the aforesaid project; and
WHEREAS, it is imperative to enter into Contract and have payment to ODOT by the April deadline so that the project can continue on schedule with construction beginning in the Summer of 2013, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the City of Gahanna enter into a Contract with the State, and the Mayor is hereby authorized to execute said Contract and other documentation necessary to proceed with this project, providing for the payment by the City the sum of money set forth herein for improving the described project; said Contract attached as EXHIBIT A, and made a part herein.
Section 2. That the City of Gahanna desires the Director of Transportation to proceed with the aforesaid highway improvement.
Section 3. That funding in the amount of ONE HUNDRED FORTY TWO THOUSAND THREE HUNDRED DOLLARS ($142,300) was set aside in the 2013 Appropriations to Account No. 652.351.5596, Water System Capital Improvement Fund, Capital Projects/Improvements, to cover a portion of the herein costs.
Section 4. That funding in the amount of TWO HUNDRED NINETY SIX THOUSAND NINE HUNDRED THIRTY THREE DOLLARS ($296,933) was set aside in the 2013 Appropriations to Account No. 325.122.5596, Capital Improvements, Capital Projects/Improvement, to cover a portion of the herein costs.
Section 5. That funding in the amount of TWENTY EIGHT THOUSAND SIX HUNDRED THIRTY EIGHT DOLLARS ($28,638) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Water Capital Improvement Fund, to Account No. 652.351.5596, Capital Projects/Improvements, to cover the balance of the herein costs.
Section 6. That ORD-0001-2013, passed January 2, 2013, is hereby amended to reflect this supplemental appropriation.
Section 7. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
