TO ACCEPT THE FINAL PLAT FOR PROPERTY KNOWN AS SCIENCE BOULEVARD EXTENSION DEDICATION PLAT; VALUE RECOVERY GROUP II AND CITY OF GAHANNA, BY KARL WETHERHOLT, APPLICANT; AND TO DECLARE AN EMERGENCY

WHEREAS, a final plat was approved by ORD-0137-2009 for this property but was not recorded in a timely fashion and has since expired; and
 
WHEREAS, City Engineer Karl Wetherholt has submitted to the City a Final Plat for property consisting of 11.016 acres; and
 
WHEREAS, Planning Commission, on February 24, 2010, after study and review has recommended to Council the approval of this Final Plat; and
 
WHEREAS, due to the impending building season and the need to move forward as quickly as possible, all for the preservation of the public peace, property, health, safety, and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  The Final Plat for TechCenter Drive Extension and Greenspace Dedication more particularly described as follows:
 
Situated in the State of Ohio, County of Franklin, City of Gahanna, Quarter Township 1, Township 3, Range 16, United States Military Lands, containing 11.016 acres, more or less, said 11.016 acres being comprised of tracts as shown in the deed to Value Recovery Group II, LLC (10.084 Acres) of record in Instrument Number 200712200217547, being a resubdivision of part of Lot 7 of TechCenter Drive Extension and Greenspace Dedication Plat as recorded in Plat Book 112, Page 79, and City of Gahanna (0.932 Acre) of record in Official Record 19462A11, being a resubdivision of part of Lot 23 of David Taylor's Subdivision as recorded in Plat Book 1, Page 10, all references are to the Recorder's Office, Franklin County, Ohio
 
be, and the same is hereby approved and accepted, and the dedication to public use of all or parts of TechCenter Drive and Science Boulevard not heretofore dedicated to public use, be and the same are hereby accepted and confirmed, subject to all requirements as set out in Chapters 1107, 1109, 1193 and 1195 of the Codified Ordinances of Gahanna, Ohio.
 
Section 2.  That Science Boulevard Extension Dedication Plat, consisting of 11.016+/- acres, meets all requirements of the L-OCT (formerly M-1 Manufacturing) zoning approved by the City in prior actions.
 
Section 3.  That the City Engineer has certified that Science Boulevard Extension Dedication will meet all requirements of storm water and design requirements for adequate on-site drainage and the ability to accept runoff from land tributary to the development.
 
Section 4.  That said Final Plat for Science Boulevard Extension Dedication Plat is attached to this ordinance as EXHIBIT A and made a part herein.
 
Section 5.  The City Engineer has submitted a Landscape Plan to Gahanna Landscape Board, which is in accordance with Chapter 913, Landscaping Requirements, as well as any Property Perimeter Requirements as set forth in Section 1167.20 of the Codified Ordinances of Gahanna.
 
Section 6.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
