Recommended for Adoption, Consent
TO ACCEPT THE ANNEXATION OF 2.33+/- ACRES FROM JEFFERSON |
TOWNSHIP TO THE CITY OF GAHANNA, OHIO, LOCATED AT 4530 N. |
HAMILTON ROAD, GAHANNA, OHIO 43230; REQUESTED BY JOSEPH C. |
DeCARLO, ET AL |
Weber stated that we do not have the dedication of the right-of-way because this is a |
case where the City of Columbus accidently connected the client to the waterline |
thinking he was in Gahanna, when actually he is not; talked to his attorney, the client |
thinks this is a right-of-way that the City will want; thinks he should receive fair market |
value; Wetherholt has stated that this is property that the City of Gahanna is going to |
need; one of the key issues is how badly does the City want the property; client is |
elderly and believes that he should get some fair share of the money for this |
right-of-way. Hogan suggested that Weber go back to the attorney with the following |
suggestions: (1) have the City of Columbus pay the $2250 since they made the mistake; |
(2) the City of Gahanna give the client $500; (3) have the resident put a well in the |
backyard. White responded or we can just take it as is. Weber stated that either the |
City will have to try to negotiate with the client and attorney or have more discussion |
with the attorney to get this matter resolved. |
Sherwood requested that this matter be postponed until the first committee meeting in |
the month of February; this will allow Weber time to talk with the client's attorney and |
bring an update to Council. |
Recommended for Postponement to a Date Certain
