TITLE

AN ORDINANCE AUTHORIZING THE CREATION OF THE ONEOHIO FUND NO. 2440

BODY

 

WHEREAS, the State of Ohio has developed the OneOhio plan, a mechanism to ensure that money from a negotiated settlement in the amount of $808 Million with the three largest distributors of opioids is distributed fairly to communities hit hardest by the opioid crisis; and

 

WHEREAS, the settlement agreement allocates 30 percent to local governments, 55 percent to a foundation that will distribute funds to projects, and 15 percent to the Office of the Ohio Attorney General as Counsel for the State of Ohio; and

 

WHEREAS, the Gahanna City Council passed RES-0028-2021 on August 9, 2021, to accept the material terms of the OneOhio settlement pursuant to the Memorandum of Understanding and consistent with the terms of the July 21, 2021, National Opioid Settlement agreement; and

 

WHEREAS, the City will receive an annual allocation over the next 18 years; and

 

WHEREAS, it is estimated that the City will receive between $102,000 and $145,850 over this period; and

 

WHEREAS, the use of these funds is restricted to the approved purposes identified under the OneOhio Memorandum of Understanding; and

 

WHEREAS, Ohio Revised Code 5705.09(F) requires subdivisions to establish a special fund for each class of revenues derived from a source other than the general property tax, which the law requires to be used for a particular purpose.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1. That the Finance Director is hereby authorized to establish the OneOhio Fund No. 2440 to separately account for any monies received through the OneOhio Opioid Settlement in compliance with Ohio Revised Code and Auditor of State requirements.

 

Section 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after the date of signature of approval by the Mayor.
