TITLE
AN ORDINANCE TO AMEND GAHANNA CODE CHAPTER 907 REGARDING DRIVEWAYS AND CURB CUTS
BODY
WHEREAS, Gahanna Code Section 907.03 Inspection requires the Chief Building Official to inspect construction of driveway “approaches,” or the portion of a driveway within the public right-of-way; and,
WHEREAS, Gahanna Code Section 909.04 defines the standards for construction of driveways as established by the City Engineer; and,
WHEREAS, inspection of driveway approaches and associated fees are currently collected through a Driveway Approach Permit through the Building Division; and,
WHEREAS, while the inspection and fees are required by Code, the Driveway Approach Permit is not a requirement; and,
WHEREAS, a Right-of-Way Construction Permit is required for construction of a driveway approach since it is within the public right-of-way; and,
WHEREAS, to improve efficiencies by limiting the number of permits required by applicants to construct a driveway approach and allowing the inspection to take place by the Engineering Division, the administration proposes amending Section 907.03 by changing the responsible party for inspections from the Chief Building Official to the “responsible Director or their designee”; and,
WHEREAS, the administration further proposes amending Section 907.04 by removing reference to commercial and industrial establishments so that specifications identified within this Section are applicable to all driveway curb cuts and match the City’s current standards.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That Code Chapter 907 for Driveways and Curb Cuts is hereby amended and adopted in EXHIBIT A attached hereto and made a part herein.
Section 2. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after the date of signature of approval by the Mayor.
