A STATUTORY RESOLUTION DETERMINING THE NECESSITY TO REPAIR OR REPLACE SIDEWALKS IN THE 2021 SIDEWALK MAINTENANCE PROGRAM AREA FOR THE CITY OF GAHANNA, WAIVING SECOND READING AND DECLARING AN EMERGENCY

WHEREAS, the Council previously adopted the 2021 Sidewalk Maintenance Program Area ("Program Area") on September 20, 2021; and
WHEREAS, pursuant to Section 521.06 of the Codified Ordinances of the City of Gahanna, the City Engineer has conducted a survey of sidewalks, integral approaches and aprons, and related areas which are in need of repair or replacement in the City; and
WHEREAS, pursuant to such survey, the City Engineer has developed a list of properties requiring repair and/or replacement of such areas and an estimated cost of improvements for each parcel in the Program Area; and
WHEREAS, the Department of Public Service & Engineering respectfully requests adoption of a Resolution of Necessity for properties located in the Program Area to allow the City to advance the Program pursuant to Section 521.06; and
WHEREAS, the Mayor recommends waiver of second reading and passage of the Statutory Resolution as an emergency measure immediately necessary to the preservation of public peace, safety, health, and welfare of the City in order to affordably and proactively maintain adequate, essential infrastructure for City residents.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Council determines it to be necessary to repair or replace sidewalks of parcels identified in the 2021 Sidewalk Maintenance Program Area, attached hereto as EXHIBIT A.
Section 2. That the Director or designee is authorized to issue notice to each property owner identified in EXHIBIT A and to proceed with the Program in accordance with Section 521.06 of the Codified Ordinances of the City of Gahanna.
